Limited Dismissal of Cases

STATUTUORY REFERENCE:

1405 (C) (21) … may also dismiss complaints if the complaint is without merit.

CIRCUMSTANCES OF USE:

For the E.D. to dismiss a complaint if the complaint is without merit, but rather an allegation including,

— the Investigative Staff concur after reviewing the case that it be dismissed, and

Subsequent to dismissing such a case,

— the E.D. shall report to the Board at each bimonthly Board meeting a list of the individuals whose cases were dismissed during the prior period. This list will appear in the Executive Director's report.
